Procedures for teachers’ resignation
According to the provisions of Article 29 of the Law on Public Employees 2010 and amended and supplemented by Clause 4, Article 2 of the Law on Public Employees 2019, teachers are allowed to quit their jobs in the following 2 cases:
- Teacher’s contract is unilaterally terminated by the unit: In this case, the teacher will enjoy all benefits according to Vietnamese law on termination of labor contract.
- The teacher unilaterally terminates the contract: In this case, the teacher needs to write teacher resignation letter and send it to the unit’s leadership and relevant parties.
When deciding to leave, depending on each case, the teacher will send written notice to the leadership of the public service unit at least 3 days or 30 days in advance. This has been stipulated in Clause 3, Article 57 of Decree 115/2020/ND-CP. After receiving the teacher’s resignation letter, the unit’s leadership and relevant levels will review and make a decision.
- Agree to dismissal: Make a decision to terminate the contract and proceed to resolve issues related to teacher termination.
- Disagreement to dismissal: The Board of Directors will answer the reason for not agreeing to dismissal to the teacher in writing.
Do teachers need to give notice before quitting?
Not only teachers but also any profession need to notify the unit in advance before quitting their job. Depending on each specific case, teachers need to notify 30 – 45 days in advance according to regulations. If working under an indefinite term contract and wanting to unilaterally terminate the contract, teachers need to give 45 days notice. If you work under a fixed-term contract and have really difficult circumstances and cannot continue your teaching career, you need to give 30 days notice.
